Public offer agreement
This public offer (hereinafter referred to as the "Offer") is an official proposal from the online store "Starchak" (hereinafter referred to as "We," "Our," "Seller") to enter into a sales agreement with a person who accepts the terms of this Offer (hereinafter referred to as the "Buyer").
The Offer is legally binding, and the Buyer’s acceptance of its terms constitutes confirmation of the agreement under the conditions set forth below.
1. Procedure for Conclusion of the Agreement
1.1. The sales agreement between the Seller and the Buyer is considered concluded at the moment the Buyer places an order through the "Starchak" online store, confirms the received data, and agrees to the terms of this Offer.
1.2. Placing an order by the Buyer confirms that the Buyer has read and agrees to the terms of this Offer.
2. Obligations of the Seller
2.1. The Seller undertakes to:
- Deliver the goods to the Buyer according to the order.
- Fulfill the delivery obligations in accordance with the terms of this Offer.
- Provide the Buyer with goods of adequate quality, as described on the website, provided the goods are not defective and comply with legal requirements.
2.2. The Seller has the right to change prices for goods without prior agreement with the Buyer. Changes take effect upon publication on the website.
3. Obligations of the Buyer
3.1. The Buyer undertakes to:
- Provide accurate data for order fulfillment (name, surname, delivery address, phone number, email).
- Pay for the order within the specified timeframe and in the amount stipulated by this Offer.
- Accept the goods provided that the goods correspond to the description on the website and are free from defects.
4. Price and Payment
4.1. The price of the goods is indicated on the website and is final. The Seller reserves the right to change prices without prior agreement with the Buyer.
4.2. The Buyer pays for the goods using the available payment systems indicated on the website (e.g., bank cards, online payments, etc.).
4.3. If the payment method requires prepayment, the goods are considered paid once confirmation of a successful transaction is received.
5. Delivery of Goods
5.1. The Seller undertakes to deliver the goods to the Buyer’s address specified when placing the order, in accordance with the chosen delivery method.
5.2. The delivery time within Ukraine may range from 1 to 5 working days depending on the Buyer’s location.
5.3. For international deliveries, the delivery time is from 5 to 14 working days.
5.4. If the Buyer does not receive the goods within the specified time due to their own fault (e.g., failure to pick up the parcel in time, incorrect delivery address, etc.), the Buyer bears the responsibility for any additional costs for re-delivery.
6. Return and Exchange of Goods
6.1. The Buyer has the right to return the goods within 14 days from the date of receipt, provided the goods have not been used and retain their original appearance.
6.2. Goods that have been damaged or used are not subject to return or exchange.
6.3. The costs of returning the goods are borne by the Buyer if the goods are not defective or if the goods are returned for reasons other than defects.
7. Liability of the Parties
7.1. The Seller is not liable for:
- Non-fulfillment or improper fulfillment of its obligations due to force majeure, including natural disasters, technical failures, supplier issues, or other circumstances beyond the Seller’s control.
7.2. The Seller is not responsible for incorrect information provided by the Buyer when placing the order.
8. Intellectual Property Rights
8.1. All materials placed on the website (photos, text, graphics, design, logos, etc.) are the property of the Seller and are protected by copyright and related rights.
9. Amendments to the Offer
9.1. The Seller has the right to change the terms of this Offer at any time without prior agreement with the Buyer. Changes take effect from the moment the new version of the Offer is published on the website.
